Legal Question in Criminal Law in California

I would like to thank the attorney who responded on my last question but here is the other part to answer his question. On the question about the Notice of Motion to return Property Illegally swized Memorandu of Points and Auhorities in Support. The criminal charges were subsequently dropped against the client.This motion is made on the grounds that the property seized is being unreasonable and there is no probable cause to believe that a crime has been committed. If any response on this part I would appreciate it. Thank you.

I believe that I answered your post before. You may want to send me a private e-mail for follow up questions. There are different code sections that authorize the procedure to get your property. For example, if it was taken under a search warrant, then that motion is governed by Penal Code section 1536. It is not clear what the property is, which cannot be returned if it is described in Penal Code section 1417.6.
