Legal Question in Criminal Law in California
Has my attorney scammed me?
I found an attorney on this website last January by the name of *Name Removed*. I paid him for services. He does not return my calls or my emails. Has he died, or is he on vacation or was I scammed?

The California State Bar website lists him as potentially inactive / inelligible to practice law. I would call the state bar and ask what his status is. Good luck.
Re: Has my attorney scammed me?
When you hire an attorney in California, for any retainer over 1000 dollars you should have received a copy of the retainer clearly stating the perameters of the retainer and the fees paid for such services. Did you receive such a copy ? Also any attorney you retain for services should return phone calls and emails. It seems you have a problem with this attorney. You may want to put in writing a letter stating you want him to cease all work on your case, you desire an accounting of time spent on your matter and a return of any and all unused monies you have paid him. You need to seek another attorney immediately so none of your legal rights are hampered. You may have to contact the State Bar to lodge a complaint against the attorney you originally hired if you do not get satisfaction. If you need to speak to me directly you may do so by contacting me at my office or thru www.wallinlaw.com. I wish you well. David Wallin

The State Bar has him listed as not eligible to practice law.

Re: Has my attorney scammed me?
You have been misinformed, my friend. Unless Mr. So and So took your case, took your money, and ran with it, why would you think he's your attorney and bad? Stop blaming everyone else, start paying a lawyer, and get it all straightened out. K?
Re: Has my attorney scammed me?
Unfortunately, the State Bar website lists information which is adverse to *Name Removed*, and it appears he might be ineligible to practice law for an extended period of time.
While I'm not excusing anything he may or may not have done in your case, practicing law is quite difficult and many solo practitioners have been known to suffer from stress, burnout, and/or substance abuse. There but for the grace of God go any of us.
If he does not return your calls or letters, you could write to the State Bar and perhaps make a claim with the Client Security Fund.
