Legal Question in Criminal Law in California

auto theft

I work for my brother's parking lot and they have monthly cars that are parked in the lot but my car broke down so I used one pf the cars parked in his garage. The owner reported the car stolen and when I came back to the garage police was waiting and I got arrested. If the owner won't press charges will my case get dismissed? I was also driving with a suspended driving license wjhat effects does this have on my case?

Re: auto theft

You have a situation there for sure and it looks like you need a lawyer. If you cannot afford a private lawyer, a public defender will be appointed for you.

If you returned the car, the charge will be unauthorized use of a vehicle, which can be charged as a felony. Driving on suspended, a misdemeanor, will probably be added for good measure.

If the owner does not want to press charges, it might be helpful to your cause. However, it is the police investigators and the DA who make the decision whether a case against you should be filed.
