Legal Question in Criminal Law in California
Automated red light ticket
I want Los Angeles County to work a little to get my automated red light ticket fine money, or who knows, maybe I'll even prevail. Here's my strategy - and pointers, corrections, or hints appreciated (even traffic attorneys don't want this case, because I'm eligible for traffic school and license is clean):
Served discovery on numerous LA County agencies, including DA. Only one has responded to date, sherriffs dept, saying to serve the DA not them (so I did). Rest have ignored and it's been over 15 days. Will soon request trial by declaration, argue that legitimate discovery requests have not been complied with and therefore in the interests of justice, case should be dismissed, or county should be required to respond to discovery requests. And in the alternative that the driver picture is not clear, as required by law. If guilty, then trial de novo, same arguments with real live judge.
Discovery requests the traffic surveys, etc. along with all images of driver, car, video, etc. Was properly served but the system just isn't really set up to handle discovery or motions in infraction cases, so no one seems to know what to do or how to respond to me. I called around to find out who to serve - they all said not us.
Thoughts?
