Legal Question in Criminal Law in California

Background check disqualifierscan it be cleaned up?

In 1998, my son was in a fight resulting in a

misdemeanor arrest & conviction for assault. He

served all 240 hours community svc & pd the $150 fine.

A 3yr summary probation was shortened to time served

(6 mo) by the judge because he wanted to go active

duty (he was in Army Nat'l Guard).

He ened up joining the Navy, who waived the incident

and served his full stint, incl the war in Iraq. Soon after

returning from his 9 month deployment, he got a

misdemeanor DUI w/no other ''complicating''

circumstances.

Now honorably discharged & studying for his FAA

Airframe & Powerplant license, he was refused what

seemed a definite job offer. He was so sure of it, that

he quit his part time jobone that was decent for a

student.

Has 9-11 made it so hard that not even an Iraq war

veteran with 2 misdemeanors will be able to find a job

in aviation maintenance or operations?

How hard will it be for him to have his records

expunged or cleaned up? Will he need a lawyer?

How should he deal with this? SHOULD he get a

lawyer? He doesn't have much money! Nor do I.

Thanks!

He should definitely have a free consultation with a lawyer to find out what can be done to clear up his record. There are many options, and also many exceptions to the rules. If he'd like to talk to me, please feel free to have him call me. Steve Mandell 310.393.0639
