Legal Question in Criminal Law in California

bad checks

I wrote two bad checks last year when my business was struggling. I was not able to cover the amount of the checks, they became nsf. I have sence gotten out of that business and now i have been getting phone calls from a collections agency threating crimial charges against me. My Question is how do i fight it, i dont have the money nor do i have means of getting the money to pay them other then payments which they will not accept.

Send them a payment. The chances are they will accept the payemnt. Then continue to make the payment each month until they are paid in full. Make the payment with a check, so that you have proof of payment.

Also the threat to bring criminal charges is a violation of the law. Next time this person calls record the conversation. If the person threatens to file criminal charges report this conduct to the department of consumer affairs.
