Legal Question in Criminal Law in California
Bailing out
My husband was charged with sodemy 3 about 16 years ago. He let two girls in to our house with his brother and they both fooled around supposedly. I for along time didn't believe he would do something like that. since then he has had to register as a sex offender.Hefailed to do this for about 3moves.now is in jail. they are not letting him out unless I bail him out, what are the chances of him getting out, and him having to go back in?

My offIce has handled many cases like your husband's. I think you would be better off hiring a highly qualified attorney rather than putting up bail now. David Wallin
Re: Bailing out
You are dealing with a very serious situation and nothing about it should be taken lightly. First, if your husband is required to register as a sex offender and does not register when he moves than he is looking at felony charges and could face prison time. They are not going to release him without bail and his release will be pending the results of his trial unless he works out some type of settlement. You need an attorney! It is very important that you do not waste time. Start shopping for a good criminal defense attorney. An attorney will be able to help you with the issues of bail and how to proceed when talking with the district attorney regarding some type of deal. I suggest you start shopping for an attorney immediately. If you do not have any ideas of where to begin you may call the local county bar association and ask for their referral list for criminal attorneys. You may want to ask some of your friends or co-workers if they know of any criminal attorneys. If you are completely lost feel free to call my office if you have any questions. Good luck
Re: Bailing out
Failing to register as a sex offender is a felony. Bailing your husband out will free him pending trial, but if he is convicted he will be sent to prison. You have not provided much factual detail, but I see no reason for optimism about his chances.
