Victor Hobbs did a fairly good job of responding to the specifics of your question, but I think you should definitely sit down with a criminal lawyer in your area and discuss the case fully. You've asked some questions, but there are many, more important questions and issues to discuss, not the least of which is "can they even convict you of the crime?" Most criminal lawyers give free consultations. Take one or two for 2 different perspectives. Good luck.
Re: Bank Larceny
Thanks for your posting. I actually agree with both answers you've been given.
You've asked "if I'm convicted what am I looking at". There is no such thing as "bank larceny", but if you have been charged with Penal Code 506, (which is my best guess since this is your employer), then the sentencing range for this is either 16 months, 2 years, or 3 years in state prison, based upon the dollar amount taken and other factors, including your LACK of any priors.
The big factor here, as mentioned by another attorney, is, "can they prove this case?" Most attorneys offer a free consultation, and I urge you to talk over this case with as many attorneys as you can, and be frank and honest with as many details as you know.
This is a serious matter, and the decisions you make now can affect the outcome of many things for you in the future. I'm sorry to hear you got involved in this, but I am willing to help you in any way that I can. I invite you to email me directly if you have any questions.
Re: Bank Larceny
You're looking at 5 years on the maximum side and something like 30 days in the county jail, and then probation with a lot of community service. The longer sentence if none of the money is recovered, and the shorter if you can some how help the authorites recover some or all of the money. This guy (your now ex-boyfriend) didn't do you any favors. So don't do him any favors. So realistically do all you can to help recover the money. Even if the money is spent before he is caught helping is a good thing and will soften your sentnce. Remember that you serve 50% of the sentence, and a 5 year sentence is served in 2 1/2 years actual time. You'll be appointed a Public Defender or conflict attorney, and follow his advise.
