Legal Question in Criminal Law in California
I was in a little bar tiff in 2005. The police officer contacted me in my home in the county to take the report. I was honest and never heard anything about it again. I worked in a restaurant where I served p.o. daily. I did not move out of my home for 8 months and then moved to another home in the same county. 3 years ago I worked at a autistic group home where I had to have a full background check and was cleared. Also I had a speeding ticket in that county 4 months later which I paid off and never was told anything by the clerk. I was recently at a baby shower on the 31st. I was informed from a friend who works in the sherriff office she had typed up a warrant for me two weeks ago. I contacted the clerk on the 2 and she said I do have a warrant and to come in on monday and put my self on the docit. When I talked to the clerk she said they sent it to a house that I lived in the year before. I have all the paperwork to prove I didn't live there and I am just wondering what is going to happen. Very scared. I have no prior criminal record. Oh yea the crime filed was a misdemenor battery charge. Thanks for any answers. Another thing right after I spoke to the clerk on the second I contacted the Da's office and they had no record.

You are going to have to find out where the criminal charges are filed, and have an attorney defend you of the criminal charges. There is no way that you could be convicted in your absence, but they want to charge you now. You are going to have to defend yourself, regardless of where you lived when they tried to serve you earlier.
