Legal Question in Criminal Law in California

battery while on informal probation

My husband is 19 years old we got into an argument that got out of hand and the police was called he threw something at me but did not put his hands on me. He was charged with battery and sent home. He is on informal probation from a vandilism incident that happened when he was 15 years old. His court date is coming up and im worried that he will be put in jail. My daughter and I could not survive without him. What do you think we should do get a lawyer or will he most likely not be put in jail?

You should consult with an attorney. If you cannot afford an attorney, one will be appointed for you. Your husband should not talk to anyone without a consultation. He may be able to avoid jail, but it depends on whether it is charged as a felony or a misdemeanor. You can contact my office for a consultation.

I'm not sure *you* need a lawyer, but your husband definitely does. Hire one if you can afford to, and get a public defender if you can't. Legally his situation isn't all that complex, but he needs a good advocate on his side.

Good luck.
