Legal Question in Criminal Law in California
Bench Warrent
I was given DEJ about 6 1/2 months ago. My legal assistance assured me that he was going to be able to 'take care of it' for me so I wouldn't have to attend the classes therefore I never went or enrolled. I, for some reason, thought my court date was Oct. 11, 2008 and it turned out to be on the 1st. I now have a bench warrant.
Here's where it gets yucky. I was arrested about a month ago and charged with a misdemeanor prostitution charge. I have to attend court this Friday. Question is, may I go to the 1st court and request my warrant be lifted myself or do I really need a lawyer to do it to avoid going to jail? I am hiring private council. But not sure if they're available to do this for me.

You should have a lawyer do this for you.
It was a mistake to believe a legal assistant could "take care of" part of your sentence. The judge will not be sympathetic if you tell her this is what happened. You will want an experienced lawyer arguing on your behalf, since the risk you will be sent to jail is quite real.

Retain a lawyer no doubt. You are in a little bit of a sticky situation. A lawyer could help a lot.
