Legal Question in Criminal Law in California
If I let some one borrow my car and I get a call from the police saying someone stole from a store am I liable?
1 Answer from Attorneys
If you knew (or should have known) that the person you lent the car to was going to use it to commit a crime, then letting him borrow it may also have been a crime. There are also other scenarios in which it could be a crime, but they would be based on additional facts. You haven't given us enough information to say whether any of them might apply here.
But whether you actually committed a crime and whether you appear to have committed a crime are different questions. The authorities don't have crystal balls, and can only act on the information available to them. That limited information might make it look like you were directly involved, or that there is some other reason to charge you with a crime.
You should probably consult with a local criminal defense attorney -- *before* you talk with the police -- and give her more info than you've been able to provide here. She will be better able to assess your situation. And you may want her to go with you to any police interviews. Innocent people sometimes say things that make them appear guilty, and guilty people sometimes say things that make their guilt much easier to prove. Either way, a lawyer can help keep you out of trouble.
Good luck.
