Legal Question in Criminal Law in California

I bought a car 4 months ago from a dealership. They never smogged it, then called me back and spent 3 hours putting something I didnt ask them to put on and made my car lose 7 miles to the gallon. Then when I went back to the dealership to tell him he took the keys from me and I called the police. The police said that the car cant leave the lot without it being smogged. So he leaves with my car. I wait and tell him the real issue is my mileage. He says there is nothing he can do and I leave. Do I have a case agiants his dealership? He also called me a little shit and pushed me...then took my keys.

You may have a civil lawsuit against the dealership for conversion, if they kept your money and the car. If the police won't do anything, and the district attorney won't investigate a case, there is nothing you can do in the criminal system as a private individual.
