Legal Question in Criminal Law in California

My boyfriend was arrested for a warrant and got sentenced 16 months , he is currently in orange county jail and did not get taken to a court date he had for a cite and release that happened the same time as he was arrested for the warrant, so now he has a failure to appear warrant and is still in custody, can he fix this while in jail so his release date isnt changed?

If the reason he did not show up to his court date was misfeasance on part of the Orange County jail then he needs to relay this information to his public defender or his private attorney. Judges can be very understanding when law enforcement or prison officials screw up.

Just make sure this information gets to the judge somehow.

Mr. Wheeler is correct. The problem is your boyfriend must get the information to the Judge. He should ask to see his public defender or his private attorney and explain the situation. He can make a request to see his attorney.
