My boyfriend is 17 and I am 21, we had a baby together and he lives with me, am I commiting a crime of sex with a minor? He was kicked out of his moms house and living with friends a year or so prior to us meeting if it makes a difference. Thank you

As a matter of fact, it is a felony to have sex with him in California.
