Legal Question in Criminal Law in California

My boyfriend is facing a 422PC with GBI. This is his first offense and the charge is a felony. The only other offense he has committed is petty theft. What type of sentencing is he looking at? I was told by the DA that he could receive a year probation, DV classes or at least 9 months in jail in which he may have to serve only 50% or less. He has been olcked up since August 29, 2011. Will they credit that time?

There are some things about your question that sounds confusing. A criminal threats charge having a GBI enhancement, seems very umlikely. So perhaps you are talking about an assault (245 pc) with GBI. No-one can say what the sentence would be unless we were the attorney for your boyfriend, and had been having negotiations with the D.A. The worst thing would be the Felony conviction as a convicted felon, jobs are few and far between. You need to speak to a highly qualified attorney so he/she can hear all the facts and you could be given an answer with greater particulars. Also you need to be sure what charges your boyfriend is facing. The only question I can specifically answer is that your boyfriend will get credit for the time he's doing in custody against the final disposition. I wish you well................ David Wallin
