Legal Question in Criminal Law in California
My boyfriend was given a 16 prison sentence & released to the streets on May 17 time served.
When he went to check into parole he was told the judge had made an error & gave him an
illegal sentence. The minimum is 2 years. They said he would have to go back to court to get
resentenced & serve the additional time. Can they do this? He is sitting in San Joaquin
County Jail unsentenced & goes back to court July 17. Please help me with the correct legal jargan
that will get him released ASAP. Thank you

To answer your question we would need to know the number of days he spent in jail prior to being released and the charge he was sentenced on.
