Legal Question in Criminal Law in California

My boyfriend was sentenced to 3yrs 8 mths on a felony charge in California. He filed 1381's on pending misdemeanor traffic cases to clear bench warrants and get everything to run concurrent. The one county brought him to court and his PD had him take a plea of no contest to the VC 14601 charges and dismissed his drug possession charges, however, we just found out from another county DA that he cant be prosecuted for non-felony traffic offenses while serving a prison term pursuant to VC41500 and those charges should have been dismissed. What can we do now?

This seems to be something that needs to be addressed by the public defender. I'm sorry I can't be more help, but he has/had an attorney.
