Legal Question in Criminal Law in California
My boyfriend's public defender has refused to request a new court date for him. He would like to ask for a modification of release date. The public defender said that the judge would refuse it so she is not going to follow through with his request. Is this legal?

Yes. Attorneys are officers of the court and cannot make every motion requested by a client. We have to follow certain rules and cannot make frivilous or unwarranted motions.
