Legal Question in Criminal Law in California

Breaking and entering?

A few days ago, my 17 year old son

who had finished his work day at a

job where he gets quite dirty, met up

with a group of 5 friends. He went to

another friends house. The friend

was not home. Using a hidden key-

without permission, the boys entered

the home. My son took a shower and

them ''borrowed'' some clean cloths.

They were caught in the home by a

woman feeding the friend's cat.

The police were not called. Had they

been called, what charges would

likely to have been filled against my

son, and what would have been the

likely penalty for a first time

offender?

I am looking to put the fear of God

into the boy.

Re: Breaking and entering?

He probably would have been charged with burglary, convited of at least breaking and entering, and given lots of probation and maybe some jail time.

Do not use the criminal justice system (or the threat of it) to punish your boy. If he is arrested or charged, get him the best lawyer you can afford. You could take him to the criminal courthouse to watch other burglars being sentenced and dragged off to prison.

Re: Breaking and entering?

Your son's behavior could have ended in residential burglary charges, which is a strike, or at a minimum trespass/breaking entering. Juvi hall or camp placement would have been possible as punishment. It is better he avoids such behavior in the future although I am not sure how hard you should come down on him. He needs to be careful but he does not sound like a bad kid.
