Legal Question in Criminal Law in California
My brother was charged in Virginia 15 years ago as a sex offender, moved to California where he went to register as a sex offender, the officials told him he didnt have to register and now he is being charged by VA police with failure to register, What can we do?

Well, he was supposed to register in Virigina, where he was convicted. So you need to respost this question in the category for Virginia attorneys to answer
yes it sounds like something your brother was required to do in the past (in Virginia) and failed to do (in Virginia) ... Virginia is the place to address if that is the issue.
other than that, my answer remains the same:
Who do you mean by 'the officials'? Who told him that he didn't have to register - in California?
Your brother should go back to who told him (in California?) that he didn't have to register (in California) regarding a Virginia conviction, I suppose & then double-check that with some local California criminal defense attorneys.
... but I don't see Virginia's jurisdiction over it.

If your brother has been charged in Virginia, then you should re-post your question under Virginia law. Few California lawyers can competently discuss what Virginia required him to do.
