Legal Question in Criminal Law in California
My brother has been found guilty for Disuade or Prevent a witness 136.1 as a felony. If he has NOT been found guilty for participating in a street gang does the enhancement automatically take effect? Or if he only has the 1 136.1 felony charge what would be his max sentence?

He only gets sentenced on what he is found guilty of. He cannot be sentenced for something he was acquitted for.
