Legal Question in Criminal Law in California

My brother is incarcerated and awaiting sentencing for the crime of Attempted murder and assault with a deadly weapon. He got into a car accident and then fought with the driver of the other car. He ended up hitting the guy in the head with a stick. Jury trial happened and he was found guilty. I read some things and it seems that attempted murder and assault with a deadly weapon on similar crimes. he didn't commit 2 crimes only one. How can both charges remain.

He can be charged and convicted on both offenses. But if you are correctly presenting the facts he can only be sentenced on the attempted murder.
