Legal Question in Criminal Law in California
My brother in-law is trying to charge me with Trustee Embezzlement.
He has left me voice mails, that he is going to the district attorney.
Although he does not have a case. From reading other cases,it appears that I can be arrest and then present my case afterwards.
I was hoping to be advised on what type of lawyer I would have to get.
Would this be a criminal lawyer.

You should consult with an attorney regarding potential criminal charges. You may also want to retain a CPA to audit the trust to show that there was no embezzlement. Also do not discuss the matter with either the brother in-law, the police or any other person except your attorney.
I agree with Mr. Johnson. Your brother in law could try to have criminal charges brought against you (though it's up to the DA to prosecute) but he can also decide to pursue a civil suit against you. Your best bet is to consult with an attorney to determine how you can avoid not only criminal proceedings but also civil litigation. Even if your brother in law's case is nonexistent it can still be very expensive and time consuming for you to defend yourself.
