Legal Question in Criminal Law in California

What happens next...

My brother was recently arrested for possession of brass knuckles. From reading other posts it looks like he's up for a misdemeanor. What I am wondering is what is the court process? Does he have to hire his own attorney or will the court appoint one? Will there only be one court session or multiple ones?

Brass knuckles can be charged as a felony as well.

Your brother needs an attorney. One should always fight criminal charges in order to keep the record clean, if for no other reason. He can hire a private attorney or, if he demonstrates that he cannot afford one, he will have a public defender appointed for him at his first hearing in court. Generally, a private lawyer will have more time and dedication to his case. Also, a private lawyer can start working right away, by calling and writing to the police and the DA to have the whole thing dismissed before the first court date.

The case could be dismissed or resolved right away or could drag on for a long time depending upon the quality of your lawyer, the disposition of the DA and the judge, where the case is located and other factors such as whether the accused has prior criminal record. Difficult to predict without knowing more facts.

Hope this helps. Feel free to contact me for further consultation.
