Legal Question in Criminal Law in California
My brother was at the same site as a gang related murder. He had nothing to do with what happened but was taken in to the police department and questioned and told he was a suspect even though he never was. They talked him into saying a few things to get himself out of trouble. Now he has to go on the stand and he is being threatened by the "gang" of persons actually responsible for being a "snitch". He is scared to death to go on stand next week. is there any way out of it? Can he recant his statement if he is in fear of his life?

He's most likely under subpoena. Unless they release him from the subpoena he will be facing contempt. He will be in trouble probably with prosecutors if he lies on the stand. He should testify and accept the consequences.
