Legal Question in Criminal Law in California

My brother use to work for target was caught at target for stelling over 2500 worth of stuff, so they arrested him but we bail him out. Now the security guard told my brother that he had notice 4 weeks ago that he has been steeling, so why was my brother not caught right their , i dont know, any help i can get so when my brother goes to court?
