Legal Question in Criminal Law in California

burglary

a person whom I intensely dislike and is not allowed in my home , entered my home while away and took some important papers from my home. I had a person watch my home while on vacation and she let him in knowing he was a persona non grata. But does that allow him to take documents? He may say she allowed him to do so but does that not make it a burglary? Can I file a police report on him and ask for a citizen's arrest. He confessed to this in a deposition and I can get a certified copy of the deposition.

You can certainly try to file a police report at the local department.

Since the person you left in charge let him in, he almost certainly will not be charged with burglary. Even if he does get charged, the document he copied can be used against you in a criminal case. You will have a better shot at keeping the document out if the case is civil.
