Legal Question in Criminal Law in California

burglary

A person, know to me, and a persona non grata , and a person never allowed in my home entered my home while I was away on a vacation. The person staying and guarding my home was never to allow my son, who was on drugs, or his unethical friend. The guardian of the home let him in and he took some papers that were important and could be used against me in a court case. Today in deposition this person admitted he entered my home , by this guardian's invitation. He admitted in depostition that he took a document and made a copy on my copy machine.

Is this person , who knew I never wanted him in my home guilty of burglary? Just because the guardian let him in does that mean he can take what he wants from my homr? Can I make a police report and demand a citizen's arrest with a certified copy from the court reporter? My privacy was invaded and an important document taken.

Please give me an answer to this dilemna. I fear the thief will say he was invited in and it's ok. I believe it is not OK.

Since the person you left in charge let him in, he almost certainly will not be charged with burglary. Even if he does get charged, the document he copied can be used against you in a criminal case. You will have a better shot at keeping the document out if the case is civil.
