Legal Question in Criminal Law in California

Burglary Sentance

My boyfriend tried to steal something from a grocery store. He was

arrested and is in custody now. He was already on informal

probation. What would be his average sentance length. How long

will he serve?

Re: Burglary Sentance

Thank you for your inquiry. It's almost impossible to answer what may seem to be a simple question like "what is the average sentence length" or "how much time will he serve" without additional facts.

One reason is that the potential sentence with a probation violation (even one under informal probation) means that he can be sentenced up to the maximum for the probation offense - but we don't know what that is. Additionally, with certain priors, he may have a "strike" or enhancement, which may mean he could do more time, as a multiple of the offense charged, or may have to serve 85% of the time, and not be eligible for good time/work time credits as most others would.

You may want to consider a more detailed consultation in person, via phone, or through email, to give specifics about his particular case.

If you want more information, please email at [email protected], and best of luck to you and him.
