Legal Question in Criminal Law in California
I'm in CA and have a domestic violence restraining order against my husband. It includes an immediate move-out order. It's been 7 weeks and he has not taken his personal items. He does have visitations and so does come here 2-3 times a week for pick-ups/drop-offs. Additionally, he would frequently ask for items from in the house the first several weeks. I did finally tell him, via email, to stop asking for items and to find a place to store it. He hasn't. Can I find him in violation of the order and if so, how do I prove and/or enforce it?

You will have to hire a lawyer and go into court to ask the judge to find your husband in violation of the order and to hold him in contempt of court. If he continues to violate the order at that point you can have him arrested.

I would need to see the restraining order to determine if he is in violation. You should take it to a lawyer and ask him/her if your husband is in violation.
