Legal Question in Criminal Law in California
Please help with car dealership fraud
I have a friend that needs help.She took her car in to get transmission work done that was covered by her warrenty.To put it short,she gets the run around and discovers that the transmission she paid for wasn't installed in her car to begin with.She paid 4000 for a genuine (dealership) tranmission and in turn has a tranmission done by an outside vendor, which was half the price.Funny thing is,the tech told her this by mistake.Now hes trying to cover his tracks and refuses to pay for the rental the dealership said they would pay for.He won't install the genuine tranmission without labor costs,telling her to buy/install things that he admittingly said she really doesn't need,and threatened if she takes them to court that its his word against hers. Theres more,but I don't think I have much space left.Please help.She has to deal with all this out of her own pocket.Is this larceny or embezzlement?? What steps should I take?

Contact the Department of Motor Vehicles and report this conduct. Also contact the district attorney's fraud unit. If that fails then seek the assistance of an attorney.
