car leasing

hello my question is : i haven't paid my car payments for more than

4 months and i had moved from the address that they have on file

without telling my financing company so they won't reposses the

car, can i be charged for embezzlement and can i be in trouble?

I haven't been driving the car since, what can i tell the financing

company if i really want to do my payments back.

Thanks for your inquiry. You do not have a duty, unless you promise within the contract to do so, to advise of your current address and phone number. If they call the police, which is unlikely, most police agencies would advise that your matter is a civil one, and that they need to sue. I've never seen an embezzlement case involving failure to pay on an installment contract, and it's illegal for the finance company to threaten criminal prosecution.

Have you considered bankruptcy or renegotiating or restructuring the debt? Those are other options that may be attractive, depending on your total financial situation.
