Legal Question in Criminal Law in California

This is my case: a couple of months ago my husband and I where pulled over my a cop. My husband got arrest for having a meth pipe and have a bag of like less then $20 of meth with him.I got him out the next day. He had court like 3 months later. We went to court to find out this for some reason the evidence was not found. The lawyer told us that this happens all the time. Then he said just to wait for the next court, cause if there was no evidence find his case was just going to be closed and that he was not going to have anything on his record. We said ok then we will wait. Being this is the first time ever been in trouble before. Ok the next court come and we showed up again for the same thing.that evidence was still not found to come back again in a month. The lawyer said just to come back again, and if this time there still was nothing he was going to tell the judge to close case. Ok we did. Now this time they had found the evidence. Being my husband first time ever, he was told he could go to classes and the his record would be cleaned once finish. We said ok. The court had us back and forward for a couple of months, because thete was a waiting list to get into the classes. Ok my husband got enrolled but he really didnt go to the classes. He possible just went like 2 or 3 times. Now we have to go to court again to show complete of program. We are alittle scared, what could happen to my husband for my complete of program like the judge required? Please any information would help alot!

One of two things can happen.Either the judge can give your husband more time to finish the classes or the judge can order the case to move towards trial. If your husband is on Prop 36 he should be given another chance.

I agree with Mr. Shapiro. Since your husband apparently has a lawyer, that's who he should ask about his prospects. They lawyer knows more about the case and the judge than we do, so she is in a better position to say what the judge is likely to do.
