Legal Question in Criminal Law in California
Case # 2011019304, superior cort of California Ventura County
I have friend who has two strikes against him under the three strikes law in california 11 years ago... he was arrested this past weekend but only kept overnight and there seems to have been no bail posting... the charge was a 11550(a) which (looking at the web sites) has a 90 day sentence that must be served.
He has a court date on June 29th in California Superior court (room 11 at 9 am) it apears to be a minor intoxication problem (no specifics on the drug). My question is that if he is sent to jail on this, will it be counted as the thrirs strike and can he be put in jail for life?

No, a misdemeanor such as 11550 cannot be a third strike.
