Legal Question in Criminal Law in California
Changing a plea
If a lawyer persuaded his client into a guilty plea of possession for sales, which should have been for possession only because of the quantity (less than a gram) Due to priors of possession for sales, he didn't think he had a chance of fighting the case, so he pleaded guilty, but come to realize that through all this - he was never given a chance to rehabilitate himself through a program.
So, can he change his plea so that he can receive such a sentence to admit to a progam? He was sentenced this year in March for 2 years.
Your feedback is greatly appreciated.
