Legal Question in Criminal Law in California

Changing my plea

Hi, I think I have made a terrible mistake in accepting a plea bargain. Basically I need to know if I can change my plea after I have signed a deal or is it set in stone? Is there any way I can overturn it and take it to trial? Do I have ANY options? I would grealy appreciate any assistance.`

Re: Changing my plea

It is difficult to get the court to with draw you guilty plea and reinstate the not guilty plea and set the case for trial.

The court will not withdraw a guilty plea when you have "buyer's remorse" that is you wish you had not bought the plea bargain.

Generally the court will withdraw a guilty plea only if it was obtained through the violation of one of your basic rights, such as; ineffective counsel, pressure to settle so charges against a family member will not be pursued, etc.

You should discuss this matter fully wiht an attorney. If you can afford to do so discuss the facts with an attorney not associated with you present attorney.
