Charged with Assault and Intent to do bodily harm

My Brother was charged with Assault and Intent to to bodily harm in Santa Clara County. This is his first offense, what kind of sentencing is he looking at? Is it possible for him to get probation and/or work release as it is a first offense plus he has been drinking.

The charges are serious and he should be represented by an attorney. He or his family should determine if they can afford to hire a private attorney. If he cannot afford a private a public defender should be appointed.

Depending on the facts his sentence could range from county jail to state prison. In Santaa Clara county many of the assistant district attorneys routine over charge.

Get a copy of the police report, if you can they are provided only to the defendant or his attorney, then get an interview with an attorney. A short conference should allow the attorney to give a much better idea what to expect.
