Legal Question in Criminal Law in California
Charged with 243(C)(2)
My daughter's boyfriend was charged with 243(C)(2), 69, 148(A)(1). At this time he is incarcerated until pretrial. His bail was set at $35,000. This bail was not reduced at his arraignment. He pleaded not guilty. His pre-trial is 02/27/09.
His family does not have the additional money for a lawyer, so he was assigned a public defender. At this time he has not had contact with her.
There are 4 witness' to the incident, but they are all from the same house (which is friends of the defendent).
He was not intoxicated or under the influence. He has not been in trouble prior to this incident. He is only 18.
A neighbor called the sheriff's office to report a domestic violence call to my home, even though there was not one. I have an investigation ongoing with the same person that made the phone call for taking nude pictures of my 14 year old daughter by breaking into my home, so this phone call was made only to cause trouble for my household...and did.
Please help!

You are a sweetheart for caring for your daughter's boyfriend. Kudos to you. Unfortunately, no one here in this forum can help you. For one, you just provide a few facts without asking any questions. Moreover, only a lawyer who is thoroughly familiar with the facts of the case - not only what you know but, most importantly, what is in the police reports, for example, can provide any realistic evaluation of the case.
As far as what you describe with regard to the public defender, it is not uncommon. Even the best public defenders are often overworked and cannot deal with all their cases in a timely fashion. I recommend defendant's family put together their resources to retain private counsel.
