Legal Question in Criminal Law in California

can I be charged with a felony if a dog came in my yard and I was worried about it getting hurt from my dog's and I asked my friend to take it down the road so it wouldn't get hurt. About 10-11 hours later some man came over and asked me if I seen his dog and he descibed what it looked like. I told him yes and I had a friend take it off down the road, because I was worried about it getting hurt and he would keep crawling under the gate to get back in the yard. The owner called the police and now they are going to charge my witha felony. Can they do that when I didnot know who the dog belonged to I just wanted it out of my yard, I did not keep it nor did I know at that time who the dog belong to at that time. What do I need to do not get in to trouble,

Yes, if you knew the dog belonged to the owner, you can be charged with theft of an animal. Feel free to call me for a free consultation.

I personally, based on your facts, don't see ANY crime. But there may be facts you left out, or law enforcement believes there is more to the story than you have stated. Call me, if you want, as I have been practicing Criminal Law for 25 years and am a Former Deputy District Attorney. If we speak for 10 to 15 minutes by phone, I may be able to see what's going on and give you advise regarding what you should do........David Wallin
