Legal Question in Criminal Law in California
Who could be charged?
O.K. this is not a homework assignment...My friend's husband had this happen to him. The neighbor called the police because she heard them arguing in their front yard. He was upset and said he was going to take the car and kill himself. My friend then struggled with her husband for the car keys finally pulling them from the ignition and hurt her wrist. The police show up and after seeing that her wrist was hurt during this dispute, charged her husband with domestic assault even though he didn't really intentionally want her to get hurt in their scuffle. Is that right, can they do that. I mean he didn't really assault her intentionally did he?

Get him an attorney. The cops and D.A. will prosecute. Contact me directly.
Re: Who could be charged?
Yes, he would have a defense based on the fact that hurting the wrist was not intentional. That said, he needs a good lawyer to make that defense work for him.
