Can you still be charged for a HS11550 even if you stated to the arresting officer that, 'the use was NOT CURRENT (5-6 days ago) and that you are in a detox or "comming down" stage; reguardless if the drug may still be lingering in your system?

H&S section 11550 refers to being under the influence of a drug. It does not refer to having been under the influence of a drug. You should retain an attorney or have the the public defender appointed to represent you. The attorney can discuss the facts of your case and then advise you of your options.
