Legal Question in Criminal Law in California

chargers dropped

if someone takes the blame for the crime and admits that he/she commit the crime instead of the person being accused after the prelim, can the charges be dropped and the case dismissed? if not, if it goes to trial, how much does this benefit the defendent?

Re: chargers dropped

That is a question that is best answered by the defendant's lawyer and the hopefully the person who intends to come forward will have a lawyer advising them as well. If there is a preliminary hearing then it's a felony and if it's a felony then there is potential prison among other consequences. Both parties should consult with their lawyers since those are the folks that have the most information about the case and the possible defenses.

Good luck,

My advice for YOU is keep your mouth shut as there is no guarantee that what you are proposing will have any effect except that -both- of you will wind up convicted. If you insist on this course of action, talk first to his lawyer.
