Legal Question in Criminal Law in California

no charges filed???

I was arrested recently i bailed out when i went to my court date no charges filed yet ...how long can they dangle that over my head I need to move past this and get on with my life . is there something i can do to get this finished

Charges can be filed anytime within the applicable statute of limitations..broadly stated...1 year for misdemeanors, 3 for felonies...there are exceptions...Counsel can be retained "pre-filing" to try to avoid any charges being filed.

Congratulations, you are probably a DA reject! Quit complaining and be glad all you have to do is wait out the statute of limitations. Sure beats being in jail or on probation.

I would be patient and wait while doing nothing. Each week and month without charges being filed means decreased likelihood that you will be prosecuted. It would be good if they made a final decision to reject charges to let you know but no news is not necessarily bad news at all.

They can file charges within the relevant Statute of Limitations for the crime in which they are going to charge you.
