Legal Question in Criminal Law in California

about charges pending tell me what you think please.

a buddy was arrested because his wifes friend called the police. they were in an argument and he was holding her back so she would not hit him and she fell. she did not press charges, she did not want him to get in trouble , but because her friend said so, he was arrested for domestic battery which the police said was a misdimeanor, he also tried to move why they were handcuffing him so , he was was arrested for resisting arrest to, they also charged him with being drunk , but did not take a breathalizer. he posted bail and is out, and has court some time next month. from you professional oponion what do you think will be the outcome of this case. being they were all misdemaenor charges and his wife did not want to press and charges please email me back with what you think or a suggestion, im just trying to help out a friend thanks

Impossible to give you a satisfying answer without knowing full facts of the case, especially the contents of the police reports. The big question is what the friend saw and what statements she made; also, if the friend's statements are damaging to the defendant what will the wife say? Will her version of events help the defendant?

These are the key questions. Neither the defendant nor the wife should be talking to the police without attorneys. It would be a huge plus if the wife has not made any statements yet.

A misdemeanor domestic violence conviction has serious consequences, even if there is no jail time. Defendant needs a good attorney.
