Legal Question in Criminal Law in California
check forgery and fraud under strain
A few months ago i was going through a really though time and did something very bad. I received a check for $50 dollars from someone and made it out for way more(8500).In all truth it was such a bad forgery i didnt even think it was going to go through. Well it did andi gave my abusive husband the money because thats all he wants in this world. I know its not his fault cause i did the damage but now im facing criminal prosecution and am afraid.I have been under domestic violence for a while and depressed including at the time i did this. Does that count for anything as far as helping me, and what should i do, i have no money for a lawyer and almost just want to commit suicide im so disraught. Help!

Re: check forgery and fraud under strain
Thanks for your posting, and I'm sorry to hear about what you went through.
As you know, it's the prosecutor's burden of proof to prove the case against you. Even if you admit to the police or the prosecutor that yes, indeed, you forged the document, you still have mitigating factors that you've described that go towards arguing for a lighter punishment, not a heavier one (as you know each crime has a minimum and a maximum).
If you can't afford an attorney the court will make a determination on whether or not you qualify for the services of the public defender, so don't worry about paying for an attorney. However, I might recommend that you make a free consultation with me or as many private attorneys as you can. Not only will you get a good idea of your defenses, and what you are looking at, you may find that attorneys are not as expensive as you think, as some of us take low payments and can help you out in many different ways.
I hope this helps -- but if you have any questions, please feel free to email my office, or call me directly, toll free, at 1-877-568-2977. Best of luck to you.
