Legal Question in Criminal Law in California

child abduction

I was arrested and put in jail for 4 days. DA charged me 278.5. My ex-husband went different police stations accused me denying child visitation and the case went to a detective who is in child abuse unite. The detective called me, but I was out of town with my child. I returned his called 2 times after I returned. After he talked to my family lawyer, he went ahead arrested & handcuffed me to a police station. During the interview, I told him that we have family court pending, court assigned child evaluator, my ex had stayed with my child for 3 weeks, he didn't pay child support for 1 year and other problems we had. However, he decided to put me in jail anyway because my child is with my family out of country.

The detective told me that if my child return, I'll be fine. Then about 72 hours after I bailed out. The detective asked warrant and arrested me again and sent me in jail for 4 days till my lawyer bailed me out. Now I am living in fear, besides fear of my ex-(he has been abusing me)Fear the detective come and arrest me anytime. I have nightmares, and so afraid anyone ring my doorbell. My child now is already with my ex. I had a preliminary hear & waiting another court day. Please advice? Is this fair?

Re: child abduction

The best advice anyone can offer you is to get a criminal defense lawyer immediately. You will need to discuss the details of your case and answer many questions before an attorney will be able to offer any useful advice. This web site is not set up to provide the kind of back-and-forth exchange a client can have when speaking wither her own attorney.

If you cannot afford to pay for a criminal attorney, the court will appoint one for you at public expense.

Good luck.
