Yes it is a crime. Municipalities, including cities, counties and other government organizations are authorized to adopt regulations and ordinances that include infractions and misdemeanors. They cannot write a felony. A misdemeanor is a crime in California. If you settle the case for an infraction then it will be equal to a speeding ticket
