Civil Demand according to 490.5
My 15year old daughter was caught shoplifting $12.99 t-shirt at Spencer Gifts. She was arrested, merchandise was returned in new condition. We received a letter from a law firm to the parents of my daughter (me)stating they were suing us for $350 in accordance to CA penal code 490.5. If we did not pay in 15 days they would take further action. Can they legally do this? Sites on the net claim this is a scam, is it? Should I hire an attorney or will that cost more than the $350 they are requesting?
Do they have legal right to pursue or are they just trying to scare me?

Re: Civil Demand according to 490.5
Subsection b of this section provides for the payment of damages resulting from the petty theft. These damages are in addition to the value of the loss of any property.
