I'm not sure I understand the question - are you asking if a person can be charged with a crime if they vandalize a hotel room, but promise to pay later? The answer is, clearly, yes, under California law. For a vandalism charge, or even a defrauding an inkeeper charge, only an intent to destroy or an intent to defraud is necessary.
